McCartneys are pleased to be favoured with instructions to offer for sale by public auction this unique and delightfully located small farm comprising Modern and Traditional Farmbuildings, remains of the former Farmhouse together with some 38 acres of sound pasture land together with attractive amenity woodland. Occupying a fine elevated position with lovely views of the surrounding border countryside the property has much to commend it to prospective purchasers. Located just to the south of Presteigne which is the former county town of Radnorshire and famed for its Annual Arts Festival and its quality of everyday life. In August 2006 Prestiegne was awaded 2nd place in the Sunday Telegraph 'Top 10 Places to live in Britain'. Interestingly the property straddles the England/Wales border which runs across the farm from east to west.

General Remarks & Stipulations

The Folly occupies a splendid elevated position about 1mile south of Presteigne. The holding is intersected by a metalled roadway and the homestead lies at map reference SO 317 633. The market town of Knighton lies some 7 miles to the north whilst Hereford and Leominster are within easy driving distance being 23 and 14 miles away respectively.

Proceed along Presteigne by pass from the roundabout at the southern end. After 500 metres turn left into Broadaxe. Proceed along this by road and up the hill for a further 600 metres and Folly homestead will be found on the left hand side.

Is freehold.

The current occupier of the property has agreed to give vacant possession of the holding on 30th November 2011. A formal agreement has been signed to this effect and is contained within the contract papers.

Planning Consent
From informal enquiries made with the Local Planning Authority (Herefordshire), a prospective purchaser seeking to reinstate the exisiting dwelling, or build a new dwelling, would have to demonstrate an essential need to live on site, in accordance with current Planning Policy. Prospective purchasers are strongly advised to make their own enquiries regarding any specific planning requirements, prior to purchase.

The property is sold free of any ingoing. No counter claim will be alowed for dilapidations (if any) or any other matter whatsoever.

Planning Uplift
An Uplift Clause will be placed on NG 9255 (5.06 acres). This will state that should planning consent be granted on this parcel for development and if such planning consent leads to an increase in value then the vendors will be entitled to 50% of such increase in value. This Uplift Clause would be operative for a period of 25 years from the Completion Date.

Plans, Areas and Schedules
These are based on the Ordnance Survey and are for reference only. They have been checked and computed by the agents and the purchaser shall be deemed to have satisfied himself as to the description of the property and any error or mis-statement shall not annul the sale, nor entitle either party to compensation. Wayleaves, Easements
and Rights of Way
The property is sold subject to, and with the benefit of, all easements and quasi-easements and rights of way, declared and undeclared. A footpath runs adjacent to the northern boundary of NG 8846. A right of way was granted to the Minister of Agriculture and Fisheries (now Forestry Commission) in 1951. Such right of way is through the woodland comprising NG 5620 and is shown by way of the dashed line.

Misrepresentation Act
The property is sold with all faults and defects (if any) whether in good condition or otherwise and neither the vendors nor McCartneys, the agents for the vendors, shall be in any way reponsible for such faults and defects, or for any statements contained in the particulars of the proeprty prepared by the said agents.

The purchaser shall be deemed to acknowledge that he has not entered into this contract in reliance on any of the said statements, that he has staisfied himself as to the contents of each of the said statements by inspection or otherwise, and that no warrenty or representation has been made by the vendors or the said agents in relation to, or in connection with the property.

Any error, omission or mis-statement in any of the said statements shall not entitle the purchaser to rescind or to be discharged from this contract, nor give either party any cause for action.

All measurements and distances are approximate. The electrical, drainage, water and heating installations have not been tested by the Agents. (The normal enquiries carried out by a purchaser's Solicitor and the type of inspection undertaken by a purchaser's Surveyor have not been carried out by the Selling Agents for the purpose of preparation of these particulars.) Environmental Issues
A detailed inspection and assessment of materials that may contain asbestos has not been carried out by the selling agents. Although a general reference to this material may have been made, we cannot confirm whether any of the buildings are constructed of other asbestos based materials, which may be visible, inaccessible or concealed. Prospective purchasers are advised to obtain their own specialist report in relation to this matter and other environmental issues. Asbestos is considered to be a hazardous material and should only be removed and disposed of by an approved contractor. Full details of regulations regarding asbestos and asbestos based products can be obtianed from the Environmental Health Department of the Local Authority.

Health & Safety
The Auctioneers advise all prospective purchasers when viewing the property to take due care. Please note that the remains of a Quarry lies adjacent to the eastern bounary of NG 8639 and NG 8846.

Method of Sale
The farm will be offered for sale by public auction on Thursday 30th June 2011. The purchaser will be expected to pay a deposit of 10% of the purchase price at the fall of the hammer. The auctioneers reserve the right on behalf of the vendor to divide, alter or amalgamate any of the lots either prior to or at the auction if required and also sell the lots in any order.

Conditions of Sale
The property will be sold subject to the special conditions of sale incorporated in the Contract which has been prepared by the vendors solicitors. The Contract and Special Conditions of Sale will be available for inspection at the offices of the agents and the vendors solicitors for seven days prior to the date of the auction. The purchaser will be deemed to have notice of such conditions and all the terms thereof and will be deemed to bid on these terms whether or not the purchaser has inspected them. The Special Conditions of Sale having been available to the purchaser, will not be read out at the auction.

The Land
