Tyn-y-Wain Farm, Dolau is to be let on a Farm Business Tenancy from 16th November 2020 until 24th September 2025.Tyn-y-Wain consists of a 4 Bedroomed Farmhouse, Farm Buildings and 280.55 acres of pasture land and provides a prime opportunity for an existing business to expand or for a new entrant.

Tyn-y-Wain is set in beautiful countryside close to the rural village of Dolau. The village offers local amenities to include a primary school and railway station offering links to Shrewsbury and Swansea on the Heart of Wales line.The Victorian Spa town of Llandrindod Wells is located approximately 8 miles to the southwest of Dolau and offers more comprehensive facilities to include a hospital, supermarkets, primary and secondary schools, leisure facilities including a golf course and leisure centre. The market town of Knighton is some 12 miles distant.

From Knighton: Take the A488 to Penybont and Llandrindod Wells. After approximately 8 miles, passing through Bleddfa and Fishpools, the 4 x 4 garage M Burgins is situated on the left. Take the next right immediately opposite the garage for Llanbister Road Station and after approximately 200 metres take the next right towards Llanbister Road Station. Continue along this road for approximately 1 mile, Tyn-y-Wain is situated immediately on the left hand side of the road. From Llandrindod Wells: Take the A483 to Newtown. At the next roundabout turn right onto the A44. On entering Penybont, take the next left signposted Knighton onto the A488. Continue along this road for approximately 3½ miles, taking the left hand turn immediately opposite M Burgins & Son, 4 x 4 garage, signposted towards Llanbister Road Station and after approximately 200 metres take the next right towards Llanbister Road Station. Continue along this road for approximately 1 mile, Tyn-y-Wain is situated immediately on the left hand side of the road.

Method of Letting
The property is to be let on a Farm Business Tenancy for a period of almost 5 years with effect from 16th November 2020 with a term end date of 24th September 2025. Tenders are to be submitted on the attached Tender Form to the agent's office by Friday 7th August 2020 by 12 noon.

Tenancy Agreement
A copy of the proposed Tenancy Agreement can be viewed at the agent's office from 1st July 2020. This includes full details of the allocation of repairing and insuring responsibilities. The agents advise all prospective tenants to inspect the Farm Business Tenancy Agreement.

All of the land is laid to pasture. Subject to any consents if deemed necessary the land can be ploughed for reseeding or short term arable rotation. The land must be re-seeded with long term leys. A forage crop may be grown when reseeding. Land must be reseeded back to a long term pasture at the end of the term. All forage crops and straw should be consumed on the Holding. No manure or slurry is to be removed from the Property. No Potatoes or GM Crops must be grown on the land unless express permission is granted by the landlord. Permanent Pasture may only be converted to Temporary Pasture or Arable if both the Landlord and the Welsh Government give consent. The holding is to be grazed by sheep and cattle only.

Grazing Licence
The paddock area below Orchard Barn and the area surrounding The Traditional Barn & Lean-to, amounting to 0.18 acres, are to be offered on an annual Grazing Licence from 1st March until 31st December for £20. These must be kept weed free and should not be overgrazed. The field numbers are SO1668 0889 and part SO1668 1392. This will be reviewed annually.

Basic Payment Scheme (BPS)
Basic Payment Entitlements will be transferred with the tenancy of the land to the tenant. The tenant would have the right to claim Basic Payment on the forage area of the land. The entitlements will be transferred to the tenant in the 2021 trading period to be used and claimed on before 15th May 2021. The entitlements or any other form of quota allocation would be transferred back to the landlord at the end of the term at no charge to the landlord. The forage area is approximately 107.61ha. There may be a replacement scheme to BPS and the tenant must obtain and meet landlord's approval before submitting an application and claim.

Glastir Woodland Creation Premium
There is a Glastir Woodland Creation Premium on 2.93ha providing an annual income until 2026 of £879 per annum. The woodland should be stock excluded. The field numbers the scheme applies to are SO1568 7687 (0.59ha), SO1668 2550 (1.24ha), SO1668 2742 (0.58ha), SO1668 3345 (0.34ha) & SO1669 1523 (0.36ha).

No subletting will be allowed unless written permission is given by the landlord.

Fishing & Shooting Rights
All fishing and shooting rights are to be retained by the landlord.

This is the Standard Model Clauses (2015) as per the FBT Agreement which must be read.

The tenants will be responsible for the Insurance of growing crops, plant and machinery, livestock and all other deadstock and for third party liability. The landlord will be responsible for insuring the farmhouse and farm buildings.

Tenant's Obligations
The Tenant shares the water supply with Orchard Barn and will agree a McCartneys document. This also reimburses the farm building's metered electricity. The Tenant will be responsible for management of the water supply including the area of the spring and reservoir and for protecting all the above ground farm, farmhouse and farm building pipework and fittings. The Tenant will be responsible for keeping the spring and reservoir catchment and surrounding area fenced from livestock and clear of trees and brambles. At the tenancy expiry the Tenant will test the farmhouse water supply and provide a certificate of passing to the landlord, including other equipment in the house.

Incoming Valuation
The only Ingoing for the Tenant to take to at the commencement of the tenancy, which the tenant can take at valuation, is silage. There is planned to be approximately 300 Round Bales of wrapped silage available.

Rent will be payable in two equal instalments. The first payment will be due on 16th November 2020 and the second payment due on 25th April 2021, with subsequent payments being made on the same date for the next four years. The first rent instalment should be paid to the agent and then by standing order. The final half-yearly payment will be reduced on a pro-rata basis to reflect the final shortened time period.

Hedge Trimming
This must be done by the tenant. The 2020 Hedge-trimming will be carried out by the incoming tenant

Residential Occupation
It will be a condition of the tenancy that the tenant/s is/are required to live in the farmhouse, which will be their primary place of residence.

Council Tax
The tenant will be responsible for the payment of the council tax from the date of occupation. The house is currently in Band ''E'.

Agreement Costs
The tenant will be required to pay for legal costs and stamp duty (if required) in connection with the drafting of the tenancy agreement. Agent's fees will be the responsibility of the landlord.
