General
The free Range Egg Laying Unit at Nantywellan is to be let on a Farm Business Tenancy from 1st April 2021 until 30th September 2024. The Unit comprises a flat deck layout which will house a conventional flock of 13,500 hens or an organic flock of 9,000 hens.

Directions
From Knighton: Take the A488 to Penybont and Llandrindod Wells. After approximately 8 miles, passing through Bleddfa and Fishpools, the 4 x 4 garage M Burgins is situated on the left. Take the next right immediately opposite the garage towards Llanbister Road Station and after approximately 200 metres take the next right towards Llanbister Road Station. Continue along this road for approximately 1/3 mile. The Unit is located on the left just before Nantywellan homestead.From Llandrindod Wells: Take the A483 to Newtown. At the next roundabout turn right onto the A44. On entering Penybont, take the next left signposted Knighton onto the A488. Continue along this road for approximately 3½ miles, taking the left hand turn immediately opposite M Burgins, 4 x 4 garage, signposted towards Llanbister Road Station and after approximately 200 metres take the next right towards Llanbister Road Station. Continue along this road for approximately 1/3 mile. The Unit is located on the left just before Nantywellan homestead.

Method of Letting
The property is to be let on a Farm Business Tenancy for a period of 42 months with effect from 1st April 2021 with a term end date of 30th September 2024. Tenders are to be submitted on the attached Tender Form to the agent's office by Friday 21st August 2020 by 12 noon.

Tenancy Agreement
A copy of the proposed Tenancy Agreement can be viewed at the agent's office from 14th July 2020. The agents advise all prospective tenants to inspect the Farm Business Tenancy Agreement. The F.B.T. Agreement will be signed on or before 31st October 2020. Upon signing the Tenant will pay 10% of the first years rent. This will be made as a token of good faith and will be non-returnable. Such deposit will be deducted from the first half yearly rental payment that will be due on 1st April 2021 or if occupation is taken by way of the right of pre-entry at the date of pre-entry.

Basic Payment Scheme
Basic Payment Entitlements will be transferred with the tenancy of the land to the tenant. The tenant would have the right to claim Basic Payment on the forage area of the land. The entitlements will be transferred to the tenant in the 2021 trading period to be used and claimed on before 15th May 2021. The entitlements or any other form of quota allocation would be transferred back to the landlord at the end of the term at no charge to the landlord. There may be a replacement scheme to BPS and the tenant must advise and meet landlord's approval before submitting an application and claim.

Subletting
No subletting will be allowed.

Repairs
The tenant will be responsible for all repairs and maintenance to the Egg Laying Unit. The Landlord will commission an inspection of the electrical circuit and electrical apparatus contained in the Unit after each flock. Such inspection will be made by the Landlord's chosen electrical contractor and will be paid for by the Landlord. If, following such inspection, remedial work is required then this will be paid for by the Tenant. The Tenant is expected to leave the Egg Laying Unit in the same condition as they found it.

Services
The Tenant will be responsible for maintaining the water supply to the Unit, which his by borehole. The Egg Unit has its own electricity supply and the Tenant will be responsible for the electricity bills including any standing charge.

Insurance
The Landlord will be responsible for insuring the Poultry House and all equipment contained therein which was present before the Tenancy commenced.The Tenant will be responsible for the insurance of the Poultry Flock, feed, third party liability and all other equipment that the Tenant brings onto the Unit.

Incoming Valuation
There may be a small amount of feed which the Tenant will take to at valuation.

Rent
Rent will be payable in seven equal instalments. The first payment will be due on 1st April 2021 and subsequent payments being made every six months thereafter. The first rent instalment should be paid to the agent and then by standing order.Please note that applicants have to tender an annual rent for the Unit and NOT a rent per flock. Therefore the total rent payable for the term will be three and a half times the annual rent that is tendered.

Further Term
The Unit will be let under a Farm Business Tenancy for a period of 42 months. No commitment can be made by the Landlord as to any letting after this term. However should the arrangement work satisfactorily for both parties and should the Landlord so desire then the Landlords are likely to let the Unit for a further term.

Hedge Trimming
All hedge-trimming together with repairs and maintenance of the site will be the responsibility of the Tenant.

Agreement Costs
The tenant will be required to pay for legal costs and stamp duty (if required) in connection with the drafting of the tenancy agreement. Agent's fees will be the responsibility of the landlord.

Letting Details
The Free Range Egg Laying Unit at Nantywellan comprises a flat deck layout that will house a conventional flock of 13,500 hens or an organic flock of 9,000 hens. Currently the Unit houses a 9,000 bird organic flock and this is due to be depleted in March 2021. A contract is in place for a further organic flock commencing in April 2021 and which will deplete in June 2022. Such contract with John Bowler will be made available to the successful applicant. Following the depletion of this final organic flock the Tenant would be free to negotiate their own contract for either free range organic or free range conventional eggs.The Unit will be let for what will effectively be 3 flocks, hence the term of 42 months. 6.42 hectares of land is available with the Unit so as to facilitate free range status. If further land is required then a further field to the south east of the building will be made available.The Egg Laying Unit is completely self-contained with its own borehole water supply and an independently metered electricity supply. A reserve water supply by means of the farm water supply will be made available to the Tenant should a valid reason arise.The Tenant will be responsible for the Repair and Maintenance of the Egg Laying Unit and this includes the land that forms the Schedule and all gates, fencing etc. thereon.A right of pre-entry will be given and this will run from four weeks before the Tenancy commences on 1st April 2021.
